Month-to-Month Tenants Who Moved Out Without Notice Must Pay One Month's Rent

LVT Number: #27264

Albany landlord sued former month-to-month tenants in small claims court for one month’s rent after tenant moved out without 30-day notification. Tenants sent landlord a text message on April 30, 2016, that they were moving out on May 1. The court ruled for landlord. Real Property Law Section 232-b required month-to-month tenants to give landlords one month’s notice before ending their tenancy. So tenants owed landlord rent for the month of May 2016.
