MCI Rent Hike Granted for Backflow Prevention Device

The DRA granted landlord's MCI rent increase application based on installation of a backflow prevention device. Tenant appealed and lost. Tenant claimed that three buildings used the backflow device. But tenant didn't raise this issue before the DRA, and the DHCR wouldn't consider it for the first time on appeal. Tenant stated no reason why he didn't raise this argument previously.
