MCI Increase Granted for New Courtyard

The DRA granted landlord's application for MCI rent hikes based on installation of a new courtyard. Tenant appealed and lost. Tenant claimed that the rent increase was too much for the type of work performed and that the courtyard work should be excluded because this area wasn't previously available for use by tenants. The cost of the MCI was correctly determined based on the cost proved by landlord. The fact that the courtyard was previously unavailable for tenant use didn't matter. And no one claimed that the newly rebuilt courtyard wasn't accessible.
