Loss of Kitchen Space Not Minor

Tenant complained of a reduction in services based on a loss of living space in his kitchen. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that this was a minor condition that didn't warrant a rent reduction. The DHCR ruled against landlord. Landlord had installed new boxed-in gas risers along one wall of tenant's kitchen. This caused a loss of a space measuring three feet by four inches. The new risers didn't improve tenant's apartment but merely allowed landlord to continue to provide gas service, which was a required service.
