Tenant sued landlord in an HP proceeding, seeking correction of violations. Tenant testified that she hadn't had water in her apartment for more than three years, and that there was also an infestation of mice and roaches. Landlord failed to appear in court. The court ruled for tenant, found that landlord had engaged in harassment in violation of NYC Admin. Code Section 27-2005(d), and stated that landlord's actions constituted repeated interruptions and discontinuance of essential services and repeated failures to correct hazardous and immediately hazardous violations of the Housing Maintenance Code. The court awarded punitive damages against landlord for $9,000.
