Landlord appealed, claiming that tenant had refused to let the exterminator use chemicals on 10 different occasions and otherwise refused access three times when landlord tried to fix the condition. The DHCR ruled for landlord. Landlord showed that it did all it could to correct the condition. It sealed holes, sent an exterminator weekly, and provided glue traps.
