Landlord Submitted DOB Approvals for Elevators After Case Reopened

In 1988, landlord applied for MCI rent increases, based on elevator upgrading. In 1990, the DRA asked for required government approvals for the elevator work. Landlord submitted elevator equipment use permits for 16 of the 38 buildings in the complex. The DRA ruled against landlord for not submitting permits for all buildings. Landlord requested reconsideration, and submitted permits for the remaining buildings. This time, the DRA granted rent increases for the first 16 buildings only, but not for the remaining 22.

Landlord appealed, pointing out that all the DOB approvals were issued before the DRA's first order was issued, and that the work was clearly done. The DHCR ruled for landlord, and granted rent increases for the remaining 22 buildings.
