Landlord Rented Single-Family House for Transient Use

DOB issued five violation notices to landlord of a single-family home for illegally renting the house for transient use, along with related fire code violations. Landlord opposed the violations, but the ALJ ruled against landlord and fined him $11,250. Landlord appealed and lost. ECB found that landlord received a full and fair hearing, that DOB's inspector interviewed a guest staying at the building who confirmed he rented the unit for 11 days on Airbnb for $50 per night, and that the guest stayed alone in the unit.

ECB found that landlord received a full and fair hearing, that DOB's inspector interviewed a guest staying at the building who confirmed he rented the unit for 11 days on Airbnb for $50 per night, and that the guest stayed alone in the unit. There was no requirement that the inspector enter the unit to establish the charge. Landlord didn't rebut the charges.
