Landlord Proved 1984 Registration Was Filed with DHCR

Tenant complained of a rent overcharge. The DRA asked landlord for a rent history dating back to April 1, 1980. Landlord claimed there was no overcharge, and submitted a copy of the 1984 registration summary for the building. The DRA ruled that tenant had been overcharged by about $17,500, because landlord hadn't filed the 1984 apartment registration on time. Landlord appealed, arguing that it had filed the 1984 registration on time.

The DRA ruled that tenant had been overcharged by about $17,500, because landlord hadn't filed the 1984 apartment registration on time. Landlord appealed, arguing that it had filed the 1984 registration on time. As proof, landlord submitted a letter from the Rent Stabilization Association (RSA), which stated that it had mailed the form to tenant, and postal receipts showing that the RSA had mailed tenant the form. The DHCR ruled for landlord, and reduced the overcharge amount to about $200. The RSA documents were substantial evidence that landlord had filed the 1984 apartment registration form on time, despite the fact that there was no copy in the DHCR's files.
