Landlord Properly Increased Rent-Stabilized Tenant's A/C Surcharge

Rent-stabilized tenant complained of rent overcharge, specifically because landlord increased his air conditioner surcharge from $27.89 to $36.63 in September 2014. The DRA ruled against tenant, finding no overcharge. Tenant appealed and lost. There was no dispute that tenant had installed an air conditioner. And the 29th Annual Update of Section B of Supplement No. 1 to DHCR Operational Bulletin 84-4 permitted landlord to increase any air conditioner surcharge to $36.63 effective Oct. 1, 2014.
