Landlord Can Collect A/C Surcharge from SCRIE Tenant

Rent-stabilized tenant complained of rent overcharge because landlord collected rent surcharges for tenant's two air conditioners. The DRA ruled against tenant, who appealed and lost. Tenant claimed that she had only one air conditioner, but DHCR inspection found that she had two units. And, even if tenant received SCRIE benefits, landlord can collect the air-conditioner surcharge permitted in this electrical inclusion building under the Annual Update of Section B of Supplement No. 1 of DHCR Operational Bulletin 84-4.
