Landlord Offered Backdated Lease

LVT Number: 16077

Rent-stabilized tenant complained that landlord gave her a backdated renewal lease. Landlord delivered tenant a renewal lease in July 2002 with a start date of Aug. 16, 1999. Landlord claimed that tenant had refused to sign the renewal lease in 1999. The DRA ruled against tenant, and tenant appealed. Tenant showed that the prior renewal lease with prior landlord was for two years from Aug. 16, 1998, to Aug. 15, 2000. Landlord had claimed that lease was a forgery. But there was no proof of this. The DHCR ruled for tenant.
