Landlord Needn't Send Copy of Court Papers to DHCR

LVT Number: 13997

Landlord sued to evict Section 8 tenant for nonpayment of rent. Tenant claimed that landlord should have sent a copy of its court papers to the DHCR under federal regulations, since the agency regulated tenant's apartment. So, tenant argued, landlord's case should be dismissed. The court ruled against tenant. Landlord had sent a certification notice to the DHCR. This was sufficient. The back rent owed was owed by tenant, not by the Section 8 program. Landlord wasn't required to send a copy of the court papers to the DHCR.
