Landlord Left Trash Bags Out on Noncollection Day

DOS issued a violation notice to landlord for failing to store trash receptacles. The DOS inspector saw six 50-gallon plastic bags placed at curbside for collection on a noncollection day. Landlord claimed that the trash bags were left there by passersby. The ALJ ruled against landlord and fined it $100. Landlord appealed and lost. Landlord offered no details to support its claim. ECB also didn't believe that pedestrians would haul six 50-gallon trash bags to place in front of landlord's building.
