Landlord Didn't Leave Trash Out on Noncollection Day

DOS issued a violation notice to landlord for leaving five bags of garbage at curbside in front of her building on a noncollection day. Landlord claimed that the bags came from the building next door. The ALJ ruled against landlord and fined her $100. Landlord appealed and won. Landlord's super was at the building on the date the violation was issued and took pictures of the garbage bags. The pictures showed that the bags were at the property line between the two buildings but closer to the other building and on the same side of a "no parking" sign as the other building's entrance.
