Landlord Fined $300 for Leaving Open Waste at Side of Building

The DOHMH issued a violation notice to landlord for leaving unsanitary garbage conditions at the exterior right side rear yard of its building, which consisted of exposed torn garbage bags, broken boxes, wood, plastic, and metal pieces. Landlord maintained that the area in question was clean, pest-free, and well maintained. But the ALJ gave credit to the inspector's description and fined landlord $300. Landlord appealed and lost. The conditions found at the building were conducive to pests, and the penalty was proper.
