Landlord Fined $300 for Rodent Infestation

The DOHMH issued a violation notice to landlord for failing to eliminate a rodent infestation. DOH's inspector observed fresh mouse droppings and gnawed wood in one tenant's apartment. Landlord claimed that it corrected the condition immediately by hiring a professional exterminator. The ALJ fined landlord $300, finding that correction after issuance of the violation wasn't a defense. Landlord appealed and lost. Landlord could have avoided the fine only by taking corrective measures before the violation was issued.
