Landlord Didn't Submit Cost Breakdown

Tenant complained of a rent overcharge. The DRA ruled for tenant and disallowed landlord's proof of ''1/40th'' improvements since the bills and checks landlord submitted didn't show the apartment number. Landlord appealed and lost. Landlord didn't submit any document prepared at the time the improvements were made that set forth the extent and cost of the work performed in tenant's apartment. A breakdown prepared in 1988, almost two years after the work was done, wasn't a satisfactory substitute given the interrelationship between landlord and the contractor.
