Landlord didn't report an elevator accident to the DOB. The building's superintendent was injured in the accident, after falling several floors down an elevator shaftway. Two days after a newspaper reported the accident, an elevator inspector came to the building. He was let in by landlord's relative, who had an office in the building and a key to the elevator room. The inspector issued a notice of violation to landlord's relative for not promptly reporting an elevator accident.

Landlord's relative challenged the violation notice, claiming that he was neither the owner nor managing agent of the building. The ALJ found that landlord's relative had enough control over the elevator room to be held liable. He was fined $400. The ECB dismissed landlord's appeal
