Landlord Didn't Register Building or Comply with CEEFPA

LVT Number: #31626

Landlord sued building tenants for breach of contract based on rent arrears, as well as property damage. Landlord also sought ejectment of tenants. The court granted tenants' request to dismiss the case. The court ruled for tenants. Landlord failed to allege in its court papers that it was issued a rental occupancy permit for the building or that it filed a valid registration form in compliance with the Rental Registration Law of the Town of North Hempstead. In addition, removal of the tenants required a special proceeding, not an ejectment action.
