Landlord Didn't File Application on Time

Landlord applied for MCI rent hikes, based on the installation of new windows. The DRA granted the application, and tenants appealed. Tenants claimed that landlord had filed the application too late. The DHCR agreed with tenants, and revoked the rent cut. Landlord didn't file its application within the required two-year time frame. The window contractor had completed the project by Feb. 10, 1987, but landlord didn't file its application for the rent hike until Feb. 21, 1989.

The fact that landlord held back 10 percent of the payment until the final walk-through on May 5, 1987, didn't delay the completion date. The window installation was completed when the old windows were actually replaced on Feb. 10, 1987 not when all adjustments or defects had been corrected.
