Landlord Didn't File Affidavit of Service

The DRA denied landlord eligibility for 1986/87 MBR increases because landlord didn't submit, on time, a sworn statement that tenants had been notified of the proposed increases. Landlord appealed, claiming that the notice to tenants was served late because landlord got the DRA's order of eligibility late. The DHCR ruled against landlord. The DHCR's file showed that all papers sent to landlord were properly addressed. Landlord didn't prove that it got the order late.
