Landlord Didn't Accurately Report Commercial Space in Building

Landlord applied for MCI rent hikes based on exterior restoration work. The DRA ruled against landlord based on its failure to submit documentation required to process the application. Landlord appealed and lost. Landlord's application didn't indicate the presence of any commercial space in the building. But DHCR records of prior MCIs showed there were commercial tenants. The DRA twice asked landlord for a list of commercial tenants and square footage of commercial space.

Landlord appealed and lost. Landlord's application didn't indicate the presence of any commercial space in the building. But DHCR records of prior MCIs showed there were commercial tenants. The DRA twice asked landlord for a list of commercial tenants and square footage of commercial space. DHCR inspection also showed that the number of commercial spaces and tenant names at the building didn't correspond to the information submitted by landlord. In response to a further request for clarification, landlord only resubmitted information already submitted. Landlord also failed to clarify an overall room count discrepancy by ignoring the DRA's request for original layout plans or drawings.
