Landlord Could Collect Charge for Garage Space

Tenant complained of a rent overcharge, claiming landlord had charged more than the allowable Guidelines increases for garage space rental. The DRA ruled for tenant, and landlord appealed. The DHCR reversed. Prior tenant didn't rent a garage space in connection with the apartment. So landlord could set tenant's initial garage rent at the rate it wanted to. Thereafter, the garage was subject to Guidelines increases with which landlord complied. But, landlord must refund key deposit money.
