Landlord Corrected Enough Violations

The DRA granted landlord an MBR increase for the 1990-91 period, effective Jan. 1, 1990. Tenants challenged the increase, claiming that landlord hadn't removed rent-impairing violations at the building on time. The DRA ruled against tenants, and tenants appealed. The DHCR ruled against tenants. HPD records showed that the violations in question had been cleared as of an HPD inspection in February 1988. Since they were cleared prior to Jan. 1, 1989, landlord was eligible for MBR increases for the 1990-91 period.
