Landlord Complied with DHCR Order

Tenant complained of reduced services, claiming that landlord didn't fix leaks in his bathroom. In 1987, the DRA ordered landlord to correct the conditions. Tenant later asked the DHCR for a compliance hearing, arguing that landlord didn't correct the problems. In 1991, after a compliance hearing was held, the DHCR found that the problems still existed, and fined landlord. Tenant continued to complain of leak problems, so the DHCR held another compliance hearing.

Tenant later asked the DHCR for a compliance hearing, arguing that landlord didn't correct the problems. In 1991, after a compliance hearing was held, the DHCR found that the problems still existed, and fined landlord. Tenant continued to complain of leak problems, so the DHCR held another compliance hearing. This time, the DHCR ruled that landlord had made prompt efforts to cure the leaks each time they occurred, but that tenant hadn't cooperated with landlord in granting access for the repairs. Also, an independent contractor's extensive testing in 1993 revealed no new leaks in the bathroom. So, landlord had complied with the DHCR's orders to repair.
