Landlord Can't Make Rent-Stabilized Tenants Pay for Heat

New Rochelle landlord asked the DHCR for permission to modify services by replacing the building's central heating system with individual apartment gas hot air heating systems, so that tenants would control and pay for their own heat usage. The DHCR denied landlord's request. Landlord appealed and lost. Landlord's proposal was prohibited by law. Under applicable regulations, landlord was required to provide heat and hot water to tenants, and could not shift the responsibility for those essential services to tenants.
