Landlord Can Charge Market Rent to New Tenant in Parking Space

Mount Vernon landlord asked the DHCR how much garage rent it could charge new rent-stabilized tenant. In an opinion letter, the DHCR said that landlord could charge new tenant market rent for the garage space. That rent would then be subject to rent guidelines increases. The Tenant Protection Regulations are silent as to how much garage rent landlords can charge new tenants. So the DHCR would apply the New York City Rent Stabilization Code provision regarding market rents for new garage tenants.
