Landlord Can Change Tenant's Parking Space

LVT Number: 11862

Tenant complained of a reduction in services because landlord changed the parking spot she rented to one not near the front of the building. Tenant claimed this created a hardship for her. The DRA closed the case without ruling on the merits. Tenant appealed and pointed out that her lease specifically stated that she rented parking spot C10. The DHCR ruled against tenant. Tenant's original lease contained a clause stating that landlord could change tenant's parking space after giving tenant three days' written notice.
