Landlord Added Illegal SRO Units to Two-Family House

DOB issued a violation notice to landlord for illegally converting a two-family house to a four-family house plus four SRO units. Landlord claimed that only his family lived on the first floor. The ALJ found that four adults lived on the first floor but that there were two illegal SRO units on the second floor and one in the basement. The ALJ fined landlord $800 plus additional penalties of $6,750, based on $50 per day for 45 days. Landlord appealed, claiming that he had now cured the violation. ECB ruled against landlord.

Landlord didn't remove the SRO units within 45 days of the date the violation was issued. Therefore, the full penalty still applied.
