Insufficient Cleaning Efforts

DOS issued a violation notice to landlord for failure to clean 18 inches into the street in front of her building. Landlord argued that the building superintendent cleaned in front of the building at 7:00 a.m. every day and three or four other times a day as needed when he passed by. Given the large amount of debris found in front of landlord's building, the ALJ ruled against landlord and fined her $50. Landlord appealed. ECB ruled against landlord. The neighborhood was heavily trafficked, and landlord's efforts weren't sufficient to keep the area in front of the building clean.
