Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord claimed that the DRA had improperly disallowed the cost of apartment improvements in calculating the legal rent. The DHCR ruled against landlord. For most of the claimed work, landlord didn't submit documentation showing that the work had been done in tenant's apartment or had been fully paid for. Some work, such as the installation of floor tiles, was considered ordinary repairs and maintenance. Landlord couldn't get a rent increase for this work.
