Increase Included in Tenant's Vacancy Rent

Landlord applied for MCI rent hikes based on the installation of new windows. The DRA ruled for landlord, and tenant appealed. Tenant moved into the apartment shortly after the windows were installed. Landlord had already included 1/40th of the cost of the windows for tenant's apartment in tenant's vacancy rent. The DHCR ruled for tenant. Since landlord had already included tenant's windows in her rent, landlord couldn't collect an MCI rent hike from this tenant for the windows.
