HPD Denies Landlord Certificate of No Harassment

Landlord applied to HPD for a certificate of no harassment, needed before HPD would permit renovations at an SRO building. HPD denied landlord's application. Landlord appealed and lost. During the 30-day comment period after landlord's application was filed, tenants submitted sworn statements claiming harassment. An HPD investigation revealed dirty and deteriorated conditions in the building. HPD records for the building showed over 450 violations issued against the building during the look-back period.

At least 150 of those violations remained pending at the time that landlord applied for the certificate of no harassment. HPD's decision was reasonable.
