Gas Service Was Restored Before DHCR Inspection

Rent-stabilized tenant complained of a reduction in building-wide services in April 2019, claiming that there had been no gas service at the building since October 2018. The DRA notified landlord of tenant's complaint in May 2019, and landlord stated it was working on restoration of service. In October 2019, the DHCR conducted an inspection and gas service was provided at that time. The DRA denied tenant's complaint in November 2019. Tenant appealed and lost. Tenant claimed that she hadn't received a rent reduction for the period when there was no gas service.

But it was DHCR procedure that, if service was restored prior to DHCR inspection, no rent reduction would be ordered.
