Failure to Provide On-Site Super Is Minor Condition

Tenant complained of a reduction in building-wide services because there was no resident superintendent in the building. The DRA ruled against tenant, who appealed and lost. As stated in DHCR Fact Sheet #37, the agency deems complaints of landlord's failure to provide an on-site super a de minimis--that is, minor--building-wide condition that does not constitute a decrease in services.
