Exterior Lighting Doesn't Qualify

LVT Number: 9064

Landlord applied for MCI rent hikes based on the installation of exterior lighting in an apartment complex. The DRA denied landlord's application, and landlord appealed. Landlord argued that exterior lighting improved security, deterred crime, and conserved energy. Tenants claimed that the existing lighting had been adequate and that the new lighting was purely cosmetic in nature. The DHCR ruled for tenants. Upgrading security doesn't qualify as MCI work because it isn't required for the operation, maintenance, or preservation of the building.
