Eviction Warrant Delayed

Landlord sued to evict tenant for nonpayment of rent. The court ruled for landlord. Tenant then asked the court to delay execution of the eviction warrant. Tenant was appealing a decision by the Department of Social Services (DSS) not to pay his rent arrears. Tenant was also now employed, had taken in a roommate to help pay his rent, and had been given $800 from a charity to pay part of his rent arrears.

The court agreed to delay the eviction warrant, provided that tenant give the $800 to landlord, pay monthly use and occupancy on time, and deposit $100 per month into an escrow account for each month the eviction was delayed. The money in the escrow account would be used to pay rent arrears in the event that tenant lost his case against DSS.
