Eviction of Chronic Nonpaying Tenant Delayed

LVT Number: 8581

Landlord sued to evict tenant for chronic nonpayment of rent. The court ruled for landlord. Landlord had to bring three prior nonpayment proceedings in the recent past to get tenant to pay her rent. Tenant had the funds to pay the rent, but was elderly and had trouble managing her money. The court delayed eviction of tenant, to give her a chance to cure. Tenant was enrolled in a city program, Protective Services for Adults (PSA), which would help her with financial management and get her rent paid on time.

Tenant was enrolled in a city program, Protective Services for Adults (PSA), which would help her with financial management and get her rent paid on time. When PSA didn't do its job, landlord returned to court and asked for permission to evict tenant. The court gave tenant some more time to get on track. For some unexplained reason, PSA hadn't completed the work to get tenant enrolled in the program. But, that was now apparently done, and PSA had started sending landlord checks. It would be unfair to evict tenant under these circumstances.
