Emergency Repairs Made to Elevators

Tenant complained of a reduction in services. He claimed that the two building elevators were destroyed by fire and were out of service. The DRA ruled for tenant and reduced his rent. Landlord appealed, pointing out that elevator service was restored before landlord received tenant's complaint. In addition, the loss in elevator service was temporary and resulted from an emergency situation that landlord had responded to promptly. The DHCR ruled for landlord. Tenant's complaint was dated the day after the elevators were repaired and made operational.
