DRA Mistakenly Omitted Electrical Inclusion and MCI Increase

Tenant complained of a rent overcharge. The DRA found that landlord had overcharged tenant, and landlord appealed. Landlord pointed out that tenant's rent included electricity and an MCI rent increase. The DRA didn't include an additional 4 percent increase for electricity in calculating tenant's rent under Rent Guidelines Board Order 13. The DRA also didn't include the MCI increase in calculating tenant's rent. The DHCR agreed that the DRA erroneously omitted these increases. This reduced the amount of rent overcharge.
