DOB Can Correct Misspelled Name

DOB issued a violation notice to landlord for not maintaining the building's hall stairway. Landlord argued that the violation should be dismissed because landlord wasn't properly named in the violation notice. The ALJ ruled for landlord. DOB appealed, claiming that landlord's name was merely misspelled. The violation notice named ``Walter Realty Partner'' when landlord's name was ``Walton Realty Partner.'' ECB ruled for DOB. DOB should be permitted to correct the spelling in the violation notice since the incorrect name and actual name were close and since the notice otherwise provided landlord with sufficient information about the address and the condition. Landlord was fined $175.
