Dirty Ventilation Ducts

LVT Number: 11797

Tenant complained of a reduction in building-wide services based on dirty ventilation ducts in the public halls. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that the ventilation ducts were properly maintained. Landlord submitted a statement signed by ten tenants who stated that the ventilation ducts had been installed and that there was no foul odor in any hallway or floor of the building. The DHCR ruled for landlord and revoked the rent reduction.

Landlord submitted a statement signed by ten tenants who stated that the ventilation ducts had been installed and that there was no foul odor in any hallway or floor of the building. The DHCR ruled for landlord and revoked the rent reduction. The inspector's report regarding the building's ventilation ducts was vague and didn't indicate that they were operating improperly or presenting any danger. At least ten tenants indicated that the system was functioning properly. And the DRA hadn't found that repairs were needed for the other ten conditions tenant complained of.
