Damages for Slip and Fall Excessive

LVT Number: 15002

Tenant sued landlord for negligence after she slipped and fell in her apartment. After the trial, the jury ruled for tenant and awarded her $1.1 million for past and future pain and suffering. Landlord asked the trial judge to set aside the jury verdict. The court ruled for landlord. Although there was sufficient proof for the jury to rule in tenant's favor, the amount of damages awarded was excessive. The court ordered a new trial on the issue of damages unless tenant agreed to reduce the damages award from $1.1 million to $350,000.
