Contractor's Statement Regarding Pointing Required

Landlord applied for MCI rent hikes based on various improvements. The DRA ruled against landlord on the issue of pointing/steam cleaning because landlord didn't provide a signed contract, vendor's certification, or contractor's statement concerning the facade work. Landlord appealed, claiming that an owner affidavit should be permitted in place of the contractor's statement. The DHCR ruled against landlord.

Landlord appealed, claiming that an owner affidavit should be permitted in place of the contractor's statement. The DHCR ruled against landlord. To get an MCI increase for pointing/waterproofing, landlord must submit a contractor's statement certifying that the building was inspected prior to the installation and that all necessary pointing and waterproofing were done on all sections of the exterior wall where such work was required. This requirement is specifically stated on MCI forms.
