Ceiling Stains Caused by Water Penetration from Roof

Rent-stabilized tenant complained of a reduction in services based on water leaks to the hall light fixture and switch in his apartment. The DRA ruled against tenant after inspection showed that the ceiling and walls had been repaired. Tenant appealed and won. Tenant claimed that the ceiling issue remained and was caused by a roof leak. And HPD had issued multiple violations concerning the apartment based on leaks to the walls and ceilings. Another DHCR inspection showed that repairs to the hallway ceiling weren’t done in a workmanlike manner.

The areas surrounding the ceiling light fixture showed water stains. Landlord failed to cure the cause of water and moisture penetration to the hallway ceiling.
