Calculation of MCR Affected by Rent Restoration Orders

Landlord asked the DHCR for a ruling on how much rent-controlled tenant's MCR should be. The DRA ruled that it was $39 per month based on several prior DHCR orders. Landlord appealed, pointing out that some of the prior orders were rent reduction orders and that, since then, landlord got rent restoration orders from the DHCR. The DHCR ruled for landlord and sent the case back to the DRA for reconsideration of what tenant's MCR should be in light of the rent restoration orders.
