Building Owned as Non-Profit Cooperative Not Subject to Rent Stabilization

Tenant complained that landlord didn’t offer her a rent-stabilized renewal lease. The DRA ruled against tenant, finding that the DHCR had previously ruled that tenant’s apartment wasn’t subject to rent stabilization. Tenant appealed and lost. The building was owned as an HDFC cooperative corporation formed and organized under Article XI of the New York Private Housing Finance Law, and operated for charitable purposes on a non-profit basis.
