Building Has Six Apartments

Landlord claimed that her building wasn't rent stabilized because DOB records listed the building as having five apartments and one store. The DRA disagreed and ruled that the building was rent stabilized because it contained six apartments. Landlord appealed and lost. In 2006, landlord had sued to evict another building tenant in housing court. The court had dismissed the case and ruled that the building had six apartments and therefore was subject to rent stabilization. Landlord didn't appeal the court decision, and the issues were the same as those raised in this case.
