Tenant complained of a rent overcharge. The DRA ruled for tenant based on landlord's failure to register the apartment. Landlord appealed, claiming that the building wasn't subject to rent stabilization. The DHCR ruled for landlord. Landlord proved that the building had only five apartments. This was documented by the building's C of O and photographs showing the number of apartment doorways on each floor. Since there were fewer than six apartments in the building, it wasn't subject to rent stabilization.
